Chapter 7
Bankruptcy proceedings instituted under Chapter 7 of the Bankruptcy Code provide a "fresh start" for the debtor. When filing under Chapter 7, the debtor seeks to have each debt forgiven. In certain cases where debts represent items purchased on credit, for which the seller has retained a security interest, the court may require those items to be surrendered to the seller in exchange for the debt being forgiven. Once the court has determined that a debtor has fairly presented their financial situation, a discharge order will be signed granting the relief-requested forgiveness of each debt listed.

Chapter 13
Some individuals may find that while their debts are indeed overwhelming, they still have a strong enough cash flow to continue making decreased payments to their creditors. Under this structure, the debtor prepares a plan with their attorney, which takes into account all sources of income and estimated living expenses. The income that remains after living expenses are satisfied is then divided up among the creditors in a "plan" that must then be approved.
BANKRUPTCY is one of several options.
There are many others:
• REFINANCE
• CASH FOR KEYS
• SALE
• PAYMENT PLAN
The Mortgage company has an attorney and so should you. If you do nothing, these things will happen to you:

• EVICTION
• INABILITY TO FINANCE A NEW HOME
• SOCIAL EMBARRASSMENT |

Generally:
If there is a lawsuit or lawsuits against you, it may be a wise course to file bankruptcy. This would cease all attempts to collect on the future judgment the creditors may get.
Do I Answer the Complaint?
If you don't answer it, you will have no defense if it goes to trial. Doing nothing could result in a judgment against you.
Judgments:
Judgment then bankruptcy, or bankruptcy first?
When there is an option, Michigan Attorney Lawyers suggest avoid having judgments against you. Sure, the bankruptcy will avoid and remove judgments, but given a choice, it's probably preferable to file the bankruptcy before there is a judgment against you.
